School Teacher Is Jailed To A Lenient Sentence Charged With Multiple Counts Of Sexual Assault Involving Student.

Our client entered into negotiations on the day of the Trial after the Crown made numerous offers to resolve this matter. A plea resolution was carefully drafted with amendments made to the Prosecution facts, all in favour and in the best interest of the client, whereby the maximum penalty was 12 years imprisonment. Our office sought psychiatric experts to provide powerful material in the mitigation of our client.
In sentencing, Her Honour found the material highly relevant in exercising a degree of leniency to this young offender, taking into account a discount of 5% for the plea and a variation of the statutory ratio to 50% by making a finding of special circumstances.
It was a difficult case that involved a high level of negotiation with the DPP and navigating significant media scrutiny as well as preparation for trial prep & sentencing.
Our client was sentenced to a Non-Parole period of 2 years and 5 months and will be released to Parole on 31 October 2023. An outstanding result.
